Eric Stonestreet, who plays Cam on ABC’s huge hit comedy “Modern Family” tweeted this photo of himself and co-star Jesse Tyler Ferguson who plays his partner Mitchell, declaring their support for the overthrow of California’s anti-marriage equality legislation, Prop 8. The notorious ban was declared unconstitutional by the three judge panel of the 9th U.S. Circuit Court of Appeals on Tuesday. It’s likely the fight for marriage equality in California will now move to the United States Supreme Court.

Legal analysts questioned whether the Supreme Court would agree to take the case because of the narrow scope of the ruling. California is the only state to grant gays the right to marry and rescind it.
Douglas NeJaime, an associate professor at Loyola Law School in Los Angeles, said the California-specific scope of the 9th Circuit panel’s decision means the Supreme Court can uphold it without ruling “on marriage for same-sex couples on a national scale.”
“In effect, the 9th Circuit’s decision allows the Supreme Court to continue the incremental, case-by-case trajectory of marriage for same-sex couples in the United States,” NeJaime said in an email.
Meanwhile, you know the writers on “Modern Family” are itching to give Cam and Mitchell a big gay wedding. And, while we love the show, we do get a bit frustrated that they fail when it comes to showing much actual affection between the two characters despite being a long time couple with a child, a typical relunctance on the part of Hollywood to show gay men actually BEING demonstratively physical with one another. The show tries to punt off that issue by making Mitchell uncomfortable with public displays of affection but that’s a typical cop out.
If Proposition 8 is finally defeated and marriage equality returns to California, we do want to see a Big, Gay Wedding for Cam and Mitchell…with a big fat kiss at the end.
